Terms and Conditions for Skyway Express Company Shopping and Shipping Services

(1) Acceptance of Terms and Conditions for Skyway Express

1.1 By accessing and using the services provided by Skyway Express Company, you agree to be bound by these Terms and Conditions.

1.2 If you do not agree with any part of these terms, you may not use our services.

(2) Services

2.1 Skyway Express Company offers shopping and shipping services, including but not limited to purchasing and delivering goods on behalf of the customer.

2.2 We reserve the right to modify or discontinue any aspect of our services without notice.

(3) User Accounts

3.1 To use certain services, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account information.

3.2 You agree to provide accurate, current, and complete information during the registration process.

(4) Ordering and Payment

4.1 Customers may place orders through our website. Prices, fees, and payment methods are specified on the website.

4.2 Payments are processed securely. Skyway Express Company does not store credit card information.

(5) Package weights and dimensions.

5.1 Package weights: The parcels that reach us are weighed using modern and sensitive devices, with a very low margin of error.

5.2 dimensions: The dimensions of the shipments fall within the shipping price range, where volumetric weight and actual weight of the parcels are calculated, and whichever is higher is considered as the shipment weight.

5.3 True Weight: Now, Ship with our True Weight - Now pay as per Actual Weight, this would exclude packages with linear dimensions (Length+Width+Depth) exceeding 60 inches or 150 cm.

(6) Shipping and Delivery

6.1 Delivery times are estimates and may vary based on factors beyond our control.

6.2 Customers are responsible for providing accurate shipping information. Skyway Express Company is not liable for delays or non-delivery due to incorrect addresses.

(7) Vat, tax or duties

7.1 Value Added Tax (“VAT”) is an indirect tax on the consumption or use of goods and services and is applicable in many countries around the world. It's fixed at a standard rate of 5% in the United Arab Emirates and the GCC countries. Please contact your local customs office to know about the VAT rate in your country. VAT is charged at each step of the supply chain. Ultimate consumers generally bear the VAT cost while businesses collect and account for the tax, in a way acting as a tax collector on behalf of the government.

7.2 all packages that are shipped internationally are subject to taxes and duties. For more information, please check the import office site at your location.

7.3 In general, VAT is applicable only on the cost of goods, not on international import shipping charges. However custom charges might apply depending on the country you are shipping your goods to.

7.4 You will need an Electronic Export Information form (EEI) if the total value of your package is over $2,500 USD. If this is the case, we can only ship via DHL or FedEx, due to export regulations.

7.5 Import VAT is applicable on all taxable goods imported into IRAQ. As per the Tax Authority in IRAQ, Import VAT is chargeable on the total value of goods (which may include insurance, freight) and on Customs Duties (if applicable) and Excise Tax (if applicable).

7.6 All packages need to be verified by the US customs and they will check the eligibility of shipping the items to your name and address. We will notify you in case this happens and provide you with alternative solutions.

7.7 As of last update in January 2022, Iraq does not have a formalized value-added tax (VAT) system like many other countries, including those in the Gulf Cooperation Council (GCC) region such as the United Arab Emirates. However, tax policies can change, and it's possible that there have been developments since then.

Iraq relies heavily on oil revenues and has historically had a different tax structure compared to countries with a VAT system. Instead of VAT, Iraq has employed other forms of taxation, such as income taxes, customs duties, and various fees and tariffs.

It's advisable to check with the local tax authorities or relevant government departments in Iraq for the most up-to-date information on taxation policies, including the existence of any VAT or similar indirect taxation systems. These offices can provide accurate and current details regarding the taxation framework in the country.

(8) Returns and Refunds

8.1 Our returns and refunds policy are outlined on our website.

8.2 Skyway Express Company reserves the right to refuse returns or refunds in certain circumstances.

(9) Intellectual Property

9.1 All content on our website, including text, graphics, logos, and images, is the property of Skyway Express Company and is protected by intellectual property laws.

9.2. You may not use our intellectual property without our written consent.

(10) Limitation of Liability

10.1 Skyway Express Company is not liable for any direct, indirect, incidental, or consequential damages arising out of the use of our services.

(11) Governing Law

11.1 These Terms and Conditions are governed by the laws of the United States and Iraq. Any disputes will be resolved in the courts of the United States and Iraq.

(12) Changes to Terms

12.1 Skyway Express Company reserves the right to update or modify these Terms and Conditions at any time without prior notice.

(13) Payments & Orders

13.1 Our company operates with a protected and integrated e-system to receive purchase orders and shipments from customers. Therefore, the information that is written in the order fields is 100% returned to the customer, and the customer bears all consequences for all information written by him/her.

13.2 The customer will be compensated with the amount deducted from him/her in the event that his/her order is rejected, a problem or damage occurs in his/her order/shipment, or anything harmful that occurs on our part.

13.3 The customer is not entitled to reject his/her request after one day of sending, and he/she is not entitled to request a refund of the amount taken from him/her.

13.4 If the price of the item is less than your payment, the remaining balance will be transferred to your Wallet, where you can use it through the Skyway Express website.

13.5 If the item price is higher than your payment: a. Available balance in the Wallet: we will ask you to confirm the use of your available balance in the Wallet. b. No available balance in the Wallet: we will return the payment amount to your Wallet and ask you to resubmit your request arranging the full payment amount using Wallet plus your extra payment.

13.6 Our special shipping fees will be charged after comparing both the actual weight and the volumetric weight. The higher weight would be considered to calculate your shipping fees. High-volume items will be subject to additional fees as set out on the website. Please take note that our shipping fees are exclusive of all government taxes and import VAT applicable on the total invoice value of goods, including insurance, freight, and on custom duties. You understand and agree that all such taxes, VAT, import VAT will be paid by you prior to or upon delivery of your Shipment.

(14) Membership Plans

14.1 Membership plans are subject to change from time to time.

14.2 After joining a plan, you do not have the right to cancel your subscription to it or request a refund of your subscription amount to the plan.

14.3 The customer has the right to change the plan while paying the fees for the plan he wants to join in full.

(15) Definitions and Interpretation

15.1 “Package”: means any parcel that travels under one shipping label. This parcel might include any item or merchandise.

15.2 “Shipping Waybill”: this means any shipping label generated by any courier or shipping company. Every Shipment is transported under one shipping waybill and on a limited liability basis as provided by the carrier who has generated that shipping waybill.

15.3 “Dangerous Goods”: means any commodity that is classified as hazardous, inflammable, explosive, or may become hazardous, inflammable, explosive or may become liable to cause damage to any person or property whatsoever whether prescribed by laws or otherwise.

15.4 “Goods”: are any items which are the subject of the Service provided by SkyWay Express Company to you under these Terms and Conditions.

(16) Prohibited Items

16.1 All customers understand and agree that Skyway Express Company will not carry, and customers must avoid shipping: – Items classified as hazardous or dangerous goods or prohibited for international shipping by any government or international shipping laws. – Jewellery, precious stones, pornographic material, currency, stamps, deeds, hazardous material, travellers’ cheques, money cheques, money orders,

antiques, plants, or animals. – IDs and licenses issued by Governments, Passports, identification documents, or other government-issued documents. – Shipments containing Dangerous Goods will be forfeited, destroyed, or provided to government officials.

16.2 Sanctioned Business Entities: By using our website to subscribe and use our receiving and shipping services, you confirm that you or your shipments do not relate to any restricted business or personal. You also confirm that all goods being shipped are not destined from shipping to the respective shipping address provided on our site. You also confirm hereby that your name is not included in any blacklist issued by the US or by the destination country’s government or other worldwide regulatory body.

(17) "Shop" and "Ship" Laws, Instructions, and Prices

17.1 Notes for “Shop”:

If the seller asks about the extra fees for delivery and does not provide free shipping, you must add the delivery fees to the product price.

When you submit your request, this means that you have read the rules, terms, and conditions and agree to all terms.

Before sending your request, please review the items prohibited from shipping, sensitive items, and items that are easily damaged or breakable.

The final total includes all prices, Shipping Fees, customs fees, Purchase Service Fees, Product Price & delivery fees inside Iraq.

Notes for “Ship”

Tracking Number: you can get it from the Seller or Transport Company.

Shipment / Package Value: Write the total Price of purchase of your items as showing in the invoice.

The weight will be calculated after your parcel arrives at our warehouses. Afterward, we will add the shipping charges to your shipment invoice, which you can find in the Dashboard - Orders section. You can then pay it online.

Shipping Address: Write the Country for our Address you sent your items/shipments to it.

Shipment / Item Invoice: upload the invoice of your items/shipments as pdf.

(18) Misuse of one of our services

18.1 Misuse of any of our services may subject the customer or visitor to a financial penalty ranging from $50 to $500. If the management of Skyway Express decides that a customer or client is engaging in activities that are inconsistent with common decency or that damage the reputation of Skyway Express or undermine any of our services, the offender will be referred to the legal department. The offender will be punished and fined and will be prohibited from using our services in the future.

(19) Shipping policy from our warehouses to another location

19.1 We do not support shipping or transporting packages within the state where our warehouses are located, nor do we facilitate shipping packages to countries other than Iraq.

(20) Terms and Conditions of the Wallet

20.1 After charging/recharging your wallet on our website, you do not have the right to request withdrawal of funds for any reason.

20.2 You do not have the right to withdraw or claim the amounts available in your wallet for any reason, and you can use them through one of our services.


By using our services, you agree to be bound by the most recent version of these.
